Terms of Use

1. Acceptance of these Terms

These Terms of Use govern access to and use of CareerConnect.lk and its related websites, dashboards, communications and services. By creating an account, clicking an acceptance box, purchasing a plan or using the platform, you agree to these Terms.

Candidates also agree to the Candidate Terms. Employers, recruitment agencies and their authorised users also agree to the Employer Terms. The Privacy Policy and Cookie Policy explain how information and cookies are handled.

If you do not agree, do not create an account or use the platform.

2. Operator and contact details

CareerConnect.lk is operated by DXP Strategic Solutions (Private) Limited.

3. What CareerConnect provides

CareerConnect is a technology platform that helps candidates become discoverable and helps employers search for and contact potential candidates. Unless expressly agreed in writing, CareerConnect:

• •is not the employer of any candidate;
• •is not a party to an employment, consultancy or recruitment contract between users;
• •does not make hiring decisions;
• •does not guarantee candidate identity, qualifications, employer legitimacy, interviews, offers, placements, salary or performance;
• •does not provide immigration, legal, tax, employment or career advice; and
• •is not a recruitment agency merely because it provides search, messaging, verification or subscription features.

Any verification badge or review indicates only that specified checks were completed at a particular time. It is not a warranty or endorsement.

4. Eligibility and authority

You must be at least 18 years old and legally capable of entering into these Terms.

An employer user must be authorised to act for the named company, organisation or client. A recruitment agency must have a legitimate recruitment mandate and comply with the Employer Terms.

You must provide accurate registration information and keep it current.

5. Accounts and security

You are responsible for activity through your account and for keeping credentials confidential. You must not share an individual login, allow unauthorised access, circumvent seat limits or impersonate another person or organisation.

Notify us immediately if you suspect unauthorised use. We may require password resets, multi-factor authentication, additional verification or other reasonable security steps.

6. Acceptable use

You must not:

• •use the platform for an unlawful, fraudulent, discriminatory, abusive or misleading purpose;
• •scrape, crawl, harvest, copy, index or systematically download candidate or employer data except through an expressly permitted platform feature;
• •resell, publish, disclose, transfer or build an external database from platform data;
• •send spam, bulk marketing, unrelated sales approaches or deceptive recruitment messages;
• •upload malware, attempt unauthorised access, probe vulnerabilities or interfere with platform operation;
• •reverse engineer, copy or misuse the platform, except to the limited extent such restriction is prohibited by law;
• •create fake accounts, misleading profiles, fictitious opportunities or false reviews;
• •harass, threaten or exploit another user;
• •request passwords, one-time passwords, bank credentials or payment from candidates as a condition of merely considering them for a role;
• •use data to make unlawful discriminatory decisions; or
• •assist another person to do any prohibited act.

7. User content

“User content” includes profiles, company information, messages, documents, photographs, logos and other material a user submits.

You retain ownership of your user content. You grant CareerConnect a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display and transmit that content only as reasonably necessary to operate, secure, improve and promote the service according to your account type and visibility choices.

A public or featured use of a candidate’s profile requires the candidate’s applicable opt-in. A company logo or public company profile may be displayed as part of the employer service, subject to the employer’s settings and rights.

You confirm that you have the rights and permissions needed to submit the content and that it is accurate, lawful and does not infringe another person’s confidentiality, privacy, copyright, trademark or other rights.

8. Platform communications

Users may communicate through in-platform messaging, email or other enabled channels. We may process and, where necessary for safety or support, review communications to investigate complaints, enforce rules, prevent abuse or comply with law.

You should independently verify an employer, candidate, opportunity and contractual terms before sharing sensitive information, paying money, resigning from a job, relocating or entering an agreement.

9. Plans, fees and payments

Prices, features, usage limits and plan periods are shown at the time of purchase. Fees are payable in advance unless stated otherwise and may be subject to applicable taxes.

The checkout page must clearly state whether a plan renews automatically. We will not activate automatic renewal unless it is clearly disclosed and authorised. You may cancel a future renewal through the available account controls or by contacting support before the renewal date.

Except where required by law or expressly stated, fees are non-refundable after access to the paid service is activated. If CareerConnect materially fails to provide a paid service, our reasonable remedy may be re-performance, an extension, service credit or a proportionate refund.

Promotions, trials and free access may have separate limits and may be modified or withdrawn prospectively.

10. Suspension and termination

You may stop using the platform at any time and may request account deletion as described in the Data Removal page.

We may warn, restrict, suspend or terminate an account where we reasonably believe that:

• •these Terms or related terms have been breached;
• •information is false, misleading or cannot be verified;
• •there is fraud, security risk, harassment, data misuse or unlawful conduct;
• •payment is overdue or reversed;
• •continued access may harm users, CareerConnect or another person; or
• •suspension is required by law or a competent authority.

Where reasonable, we will explain the action and allow an appeal. We may act without prior notice in urgent safety, fraud or legal situations.

Termination does not remove obligations that by their nature should continue, including confidentiality, data-use restrictions, intellectual-property rights, payment obligations, disclaimers, liability limits and dispute provisions.

11. Intellectual property

CareerConnect and its licensors own the platform software, design, branding, databases, compilation, documentation and other materials, excluding user content. No ownership is transferred to users.

You may use the platform only for its intended purpose during authorised access. The CareerConnect name, logo and marks may not be used without written permission.

12. Third-party services

The platform may integrate with Google, LinkedIn, payment providers, communication services or third-party websites. We do not control their services and are not responsible for their independent availability, security, terms or content.

13. Service availability and changes

We aim to provide a reliable service but do not promise uninterrupted or error-free availability. Maintenance, security events, internet failures, third-party outages and changes may affect access.

We may add, modify or discontinue features, plans or limits. For a material adverse change to a prepaid service, we will provide reasonable notice or an appropriate remedy where practicable.

14. Disclaimers

To the maximum extent permitted by law, the platform is provided on an “as available” basis. CareerConnect does not warrant that:

• •a profile or employer is genuine merely because it appears on the platform;
• •search results are complete, unbiased or suitable for a particular role;
• •a candidate will receive contact, an interview or employment;
• •an employer will find or hire a suitable candidate;
• •messages or opportunities are accurate, lawful or safe; or
• •the platform will meet every user requirement.

Users remain responsible for due diligence, interviews, references, qualification checks, background checks, legal compliance, employment contracts and hiring decisions.

Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

15. Limitation of liability

To the maximum extent permitted by law, CareerConnect and its directors, officers, employees and contractors are not liable for indirect, incidental, special, exemplary or consequential loss, including loss of opportunity, expected salary, revenue, profit, goodwill, reputation, business, data or recruitment costs arising from platform use or user conduct.

For a paid service, CareerConnect’s aggregate liability arising from that service will not exceed the fees actually paid by the claimant for that service during the six months immediately before the event giving rise to the claim.

These limits do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or another liability that cannot lawfully be limited.

16. Indemnity

To the extent permitted by law, you are responsible for losses, claims and reasonable costs suffered by CareerConnect or another person resulting from your unlawful use, material breach of these Terms, infringement of rights or misuse of personal data.

17. Privacy and data protection

Each user must comply with applicable privacy and data-protection requirements. Employer and recruitment users who access candidate data must comply with the Employer Terms and use the data only for legitimate recruitment.

Our processing is described in the Privacy Policy. The Cookie Policy describes browser storage and tracking technologies.

18. Notices and electronic communications

You agree that account, security, billing and legal notices may be delivered electronically through the dashboard, email, SMS, WhatsApp or another contact method you provide. Electronic acceptance and records may be used to evidence your agreement, subject to applicable law.

19. Changes to these Terms

We may update these Terms. Material changes will be notified through the platform or contact details where appropriate. The revised Terms will state their effective date. Where law requires consent to a change, we will request it.

20. Governing law and disputes

These Terms are governed by the laws of Sri Lanka.

Before filing a claim, the parties should attempt in good faith to resolve the matter through CareerConnect support for at least 14 days, unless urgent injunctive relief or a statutory complaint is required.

Subject to any mandatory forum or consumer right, the courts of Colombo, Sri Lanka will have jurisdiction.

21. General provisions

If part of these Terms is invalid, the remaining provisions continue. Failure to enforce a provision is not a waiver. You may not transfer your account or agreement without our consent. CareerConnect may transfer the agreement as part of a genuine restructuring, financing or sale, subject to applicable law.

The Terms of Use, applicable Candidate or Employer Terms, Privacy Policy, Cookie Policy and any plan-specific terms form the complete agreement concerning the platform.
